Terms
of Use: All players and moderators of the Kingdoms of Telgard (Herein
"Telgard") must agree to and abide by the terms of use.
Playing and moderating in the Kingdoms of Telgard is considered
agreement to the Terms of Use. Failure to comply with these Terms
of Use may result in disciplinary action up to and including being
banned from Telgard, and/or such legal action as may be warranted.
1. Code
of Conduct: All players and moderators must abide by a code of conduct
in all out-of-character communications on Telgard's forum boards
or in communication with Telgard's moderators and/or owners. This
is to differentiate from speaking "in character" in which
case sections 1, 1.1, 1.2, and 1.3 do not apply;
1.1.
Language. Players and Moderators shall use polite language. Swearing
and insults may result in a warning and further violations penalties
up to and including banning the person in question.
1.2.
Players and Moderators shall not engage in abusive, racist, or
otherwise prejudicial attacks upon any person or group of persons.
Telgard will not tolerate discrimination of any kind due to race,
religion, creed, ideology, age, sex or gender, sexual orientation,
place of origin, mother tongue, physical disability or mental
disability.
1.3.
No player or moderator shall solicit while on the boards of Telgard
without express permission of the Creative Developers of Telgard.
Solicitation will result in the offending post being edited or
deleted, and/or in the user being banned from the boards of Telgard.
Users who wish to advertise their games or products may apply
to the Creative Developers to be included on the Links page; application
may be refused or accepted solely on the discretion of the Creative
Developers
1.4.
Rules: Players and moderators acknowledge that their characters
must follow certain rules as can be found on the rules page. They
further acknowledge that the breaking of these rules means that
Telgard may take such actions necessary to rectify the problem,
up to and including banning the player or moderator from further
activities in Telgard.
2. Ownership:
With the exception of the Fan Art Submissions, all writing, stories,
characters, art, designs, and other material on the Webpages and
Forums of Telgard belong to Telgard, and Telgard retains the right
to publish, alter, sell, and distribute all such material.
2.1.
With the exception of the Fan Art Submissions, all players and
moderators who write material for the Telgard Tribune, the Kingdom
Webpages, and other material shall retain credit for their creative
works but grant Telgard ownership and publishing rights as per
section 2).
2.2.
With respect to sections 2 and 2.1, all writing, stories, art,
designs, and other material are deemed by the writer or artist
to be original material created by them. Copying of other persons'
material is theft, plagiarism and copyright infringement and is
thus not tolerated by Telgard. Material that has been copied will
be removed immediately and notice sent to the actual authors.
Further action including banning the player/moderator and such
legal action as may be warranted may ensue.
2.3.
All Fan Art submissions belong exclusively to the author or artist
who submitted it and full credit will be given. The author or
artist MUST sign their material and declare that the art they
submit is an original work by them. The artist or author must
grant permission for users of Telgard to download and print copies
of their art for their own personal enjoyment only. Telgard acknowledges
that users of Telgard do NOT have permission to sell, alter, or
redistribute any Fan Art submission without the express written
consent of the author or artist who produced the work, and users
who sell, alter, or redistribute Fan Art submissions without permission
will be banned from Telgard. Any submission which is not an original
work of art or which is discovered to not be an original work
of art will be removed from Telgard's site, with possible further
actions to follow.
2.4.
Fair Use policy: Derivative writing and art about Telgard is considered
a compliment, but must follow certain rules:
a)
You must notify Telgard that you have created such material
b) All copies of this material must contain a reference or link
to Telgard
c) You must give Telgard permission to publish your work in either
online or offline documents, with proper credits going to the
author
d) You do not use your work for any commercial venture
3. Definitions:
"out-of-character"
means that the person is speaking as a player, and not as a character--that
is, they are not currently playing a role and thus is considered
to be having an actual conversation, discussion, or other communication.
"in-character"
means that the person is speaking as a character and playing a
role and is thus not necessarily expressing attitudes or points
of view of the players.
"derivative
art or writing" is the use of Telgard's setting, world, and
characteristics to create an original work of art--for instance,
writing a story involving one of the races unique to Telgard.
"fan
art submission" is derivative art or writing that is expressly
published or posted to the Telgard website
4. Staff
positions are volunteer positions only. Neither the owners nor the
staff receive any monetary or material compensation for their time
and effort spent within Telgard.
5. Telgard
is a not-for-profit game. Such donations as are received through
the use of the Ezboard Community Chest feature are used exclusively
to remove popups and banner ads from Telgard or for other features
such as image storage.
6. Telgard
is rated for Mature Teens aged 14+. The forums and/or website may
contain swearing, cursing, and descriptions of sex and violence,
in order to remain consistent with Telgard's roleplaying environment.
All users of this site must be 14 years of age or older or must
have parental permission to view the contents of this site.
